Terms of Service

1.1. You must be at least 18 years old or the age of legal majority in your jurisdiction to use the Service.

1.2. You must provide accurate, complete, and current information when creating your account. You are responsible for maintaining the security of your account credentials.

1.3. You are responsible for all activity that occurs under your account, whether or not you authorized that activity.

1.4. You may not use the Service for any illegal or unauthorized purpose. You must comply with all applicable laws and regulations.

1.5. One person or legal entity may maintain no more than one free trial account. Abuse of the free trial system may result in termination.

2.1. You agree to use the Service in accordance with our Acceptable Use Policy, which is incorporated into these Terms by reference.

2.2. You must not use the Service to send unsolicited bulk email (spam), distribute malware, engage in phishing, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.

2.3. We reserve the right to suspend or terminate your account if we determine, in our sole discretion, that you have violated these Terms or the Acceptable Use Policy.

3.1. The Service is offered on an annual subscription basis. The current pricing is displayed on our website and is subject to change with 30 days' notice.

3.2. All fees are exclusive of taxes, which you are responsible for paying based on your jurisdiction.

3.3. We offer a 7-day free trial for new accounts. A valid credit card is required to start the trial to prevent abuse, but you will not be charged until the trial period ends. After the trial period, your subscription begins automatically unless you cancel.

3.4. Subscription fees are non-refundable except where required by applicable law. We do not provide prorated refunds for partial subscription periods.

3.5. Storage add-ons are billed separately and prorated to your billing cycle.

3.6. If payment fails, we will attempt to charge your payment method up to three times over a 14-day period. If payment cannot be collected, your account may be suspended.

4.1. We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

4.2. We will make commercially reasonable efforts to notify you of planned maintenance in advance.

4.3. We do not guarantee specific uptime percentages unless separately agreed upon in a written Service Level Agreement (SLA).

5.1. You retain all rights to the content you store on or transmit through the Service. We do not claim ownership of your data.

5.2. We process your data in accordance with our Privacy Policy and, where applicable, our Data Processing Agreement.

5.3. We do not read, scan, or analyze the content of your emails for advertising purposes. Email content is processed only as necessary to provide the Service (e.g., spam filtering, virus scanning).

5.4. You are responsible for maintaining backups of your data. While we implement reasonable data protection measures, we are not liable for data loss.

6.1. The Service, including all software, design, text, graphics, and other materials, is owned by Velocity Digital Labs and is protected by intellectual property laws.

6.2. We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Service for its intended purpose during the term of your subscription.

6.3. You may not reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service.

7.1. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.

7.2. We may terminate or suspend your account immediately, without prior notice, if you violate these Terms, the Acceptable Use Policy, or any applicable law.

7.3. Upon termination, you will have 30 days to export your data. After this period, we may permanently delete your data.

7.4. Sections that by their nature should survive termination will survive, including but not limited to liability limitations, indemnification, and dispute resolution.

8.1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

8.2. IN NO EVENT SHALL VELOCITY DIGITAL LABS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL.

8.3. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Velocity Digital Labs and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

10.1. Any dispute arising from or related to these Terms shall first be attempted to be resolved through informal negotiation. You agree to contact us at legal@justemails.app before initiating any formal proceedings.

10.2. If the dispute cannot be resolved informally within 30 days, either party may initiate binding arbitration in accordance with the rules of the applicable arbitration authority in the jurisdiction of Velocity Digital Labs.

10.3. These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Velocity Digital Labs is incorporated, without regard to conflict of law principles.

We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes via email or a notice on the Service. Your continued use of the Service after the effective date of the revised Terms constitutes acceptance of the changes.
